FAQs

Personal Injury Questions, Answered

+How much does it cost to hire Gulotta & Gulotta?

We work on a contingency fee, which means you owe us no legal fees unless we recover money for you. Initial consultations are always free, and we'll give you an honest assessment of your case before you commit to anything.

+How long do I have to file a personal injury claim in New York?

Generally three years from the date of injury for most personal injury lawsuits. Car accident no-fault applications must be filed within 30 days. Claims against New York State are two years. Claims against a town, village, or city require a Notice of Claim within 90 days. Missing any of these deadlines can permanently bar your claim — call us as soon as possible after an injury.

+What is the difference between no-fault insurance and a personal injury lawsuit?

No-fault is automatic insurance coverage in New York that pays your medical bills and a portion of lost wages up to $50,000 after a car accident, regardless of who caused the crash. A personal injury lawsuit is a separate claim against the at-fault party for pain and suffering, future medical needs, and damages beyond the no-fault limits. Many serious injury cases involve both tracks running in parallel.

+What types of cases does your firm handle?

We handle car and auto accidents, truck and motorcycle crashes, pedestrian and bicycle accidents, slip and fall injuries, dog bites, wrongful death, construction and Labor Law injuries, and medical malpractice — across Long Island, with a focus on Suffolk County and Nassau County.

+Will my case have to go to trial?

Most personal injury cases settle before trial. We prepare every case as if it is going to trial — that preparation is what motivates insurance carriers to make fair offers. When trial is necessary to get the right result, our attorneys are ready and experienced.

+How long does a personal injury case take?

Most cases resolve within 12 to 24 months, depending on the severity of the injuries, whether liability is disputed, and whether a lawsuit must be filed. Catastrophic cases involving complex ongoing medical care can take longer. We give every client a realistic timeline at the first meeting and keep you informed at every step.

+What if the accident was partially my fault?

New York follows pure comparative negligence. You can still recover even if you were partially at fault — your recovery is simply reduced by your percentage of fault. Do not assume you don't have a case before talking to a lawyer.
